Ex-Attica guard gets $4.95 million settlement

Insurance carriers for Dr. Barbara Radolinski have agreed to pay a former Attica prison guard $4.95 million for the career-ending injuries he suffered when she veered in front of his motorcycle.

Terrence P. Higgins, chief attorney for David Apa, 29, of East Aurora, said the settlement came on the eve of a negligence trial before State Supreme Court Justice Patrick H. NeMoyer. He said Apa suffered severe leg, pelvic, shoulder and back injuries in a collision after Radolinski's car veered in front of his eastbound motorcycle on Seneca Street in Elma at about noon Aug. 29, 2007.

Higgins said Apa lost his job at Attica prison because of the numerous surgical procedures he needed and that he was not covered by a state disability or regular pension. Though Higgins was reluctant to name the defendant in the lawsuit, court officials and court documents confirmed that Radolinski was the errant driver.

Radolinski was in the news in September 2000 when she testified against former doctor Anthony Pignataro, who is now in prison for poisoning his wife. Radolinski testified she had his young son and daughter hospitalized for elevated levels of arsenic after their mother phoned her from the hospital where she was being treated, expressing concern for their safety.
